MEDIATION  

When parties are in conflict, communication often becomes strained and difficult. As the conflict ensues, tension and stress can also increase. 

When disputes end up proceeding to court, they are costly in time, money, and the outcome is unpredictable. Inevitably, people are left unsatisfied with the result. Mediation assists the parties with having direction and control of their outcome by being able to effectively work through their conflict to reach durable solutions. 

The mediator assists parties by enhancing productive and effective communication, identifying barriers and sub-issues within the conflict, and addressing the strengths and weaknesses of each side’s position. Through this process, divergent perspectives can shift which enables the parties to move towards resolution. Early resolution can significantly reduce the time and costs (emotional and financial) spent with pursuing litigation. 

ONLINE MEDIATION 

Online mediation services are available through a number of online platforms. Zoom is the online platform most often used by Kim for virtual mediations. However she has expertise utilizing other virtual platforms including Microsoft Teams, GoToMeeting, and Adobe Connect. Online mediation offered through a virtual platform allows for joint session dialogue exchange and separate communication with the Mediator (caucusing) by utilizing break-out rooms. Documents can be uploaded and shared during the mediation.

Advantages to using online mediation:

• Allows parties to communicate with each other through a platform which supports audio and visual communication. It is an effective alternative to mediating in-person;
• Offers an alternative to face to face mediation when parties are in different cities;
• Saves travel time and expenses;
• Allows mediation to take place in an environment which parties are familiar with; and
• Reduced costs to parties by eliminating the need to rent facility space and the expenses which can be incurred by the parties with travelling to an offsite mediation location.

TELEPHONE MEDIATION 

An alternative to mediating face to face. Provides flexibility for the parties to conduct the mediation from a place in which they are comfortable. It offers a time-saving benefit as the parties do not have to spend time travelling to the mediation.

MEDIATION FEES

For a two (2) party half-day mediation 

10:00 am – 1:00 pm or  2:00 pm - 5:00 pm 

$900.00 

For a two (2) party full day mediation 10:00 am - 4:30 pm

$1,800.00 

*For each additional party $300.00

*For each additional hour $300.00

* HST is payable on all fees

For half day in person mediations, the second matter must be held at the same location as the first matter. 

ADDITIONAL CHARGES

Preparation time is included with the above noted fees regardless of whether the mediation is scheduled in person, online, or by telephone. 

For in person mediations, all costs for facility rental, catering, and parking are in addition to the mediation fee.  For mediations scheduled north of Barrie, east of Oshawa, and west of Hamilton, a travel charge of $150.00 will be applied. A kilometre charge for any travel outside of the GTA will be applied. 

If travel to the mediation requires a flight to be booked, the cost of the flight will be charged. Any questions or concerns relating to charges are always welcome but should be addressed at the time of booking.

CANCELLATION FEES

All cancellation requests must be in writing.

There will be no cancellation fee charged for a mediation which is cancelled more than 30 days from the scheduled mediation date.

For a mediation which is cancelled within 30 days, but more than 7 days from the scheduled mediation date, the following cancellation fees apply and will be billed as follows:

Half day $450.00

Full Day $900.00

For a mediation which is cancelled within 7 days of the scheduled mediation date, the following cancellation fees apply and will be billed as follows:

Half day $900.00

Full day $1,800.00

***If a mediation is cancelled and the matter is rescheduled, there will be no cancellation fee billed. A facility charge may apply to cancellations which will be based on the cancellation policies of the facility. In addition, any costs associated with the cancellation of a booked flight will also be billed.***
